New Legislative Instrument IMMI 13/156 [F2013L02038] Migration Act 1958 - Determination of Granting of Protection Class XA Visas in 2013/2014 Financial Year specifies that the number of Protection (Class XA) visas that may be granted in the financial year 1 July 2013 to 30 June 2014 is 1650.
This instrument applies to all applicants who have applied for a Protection (Class XA) visa. This includes applicants who have applied before the implementation of this cap.
How will this affect my visa?
If you've applied for a Protection Visa or pan to lodge a new application then you ail be subject to the capping. When the total number of visas for this category has been granted then it will result in the remaining applicants having to wait on their other visa (most likely a Bridging Visa) until such time as the is a new batch of visas issued.
Each financial year the number is reset. If a backlog occurs (more applicants applying than the capping number of 1,650) then it can result in significant delays to visa applicants. An example of how capping can become extreme is where Carer Visas use to take around 12 months to process and now they have pushed out to 15 years.
